Whether it’s the smiling face of Prime Minister Julia Gillard or Opposition Leader Tony Abbott that Australians wake up to Sunday morning, one thing is clear: Theirs is a conservative nation.

That’s the message of what is being billed as the closest federal election down under in half a century. But it was not supposed to be this way.

When the Australian Labor Party defeated the 12-year-old centre-right Liberal-National coalition government in late 2007, the conventional wisdom suggested a political realignment.

Not only did it spell the end of John Howard – a 33-year parliamentary veteran, a friend and admirer of Stephen Harper’s, and a man president George W. Bush lauded as a “man of steel.” we were told it signalled the nadir of conservatism and the dawn of a new era of progressivism.

But that was then. On a wide variety of election issues – from climate change to constitutional change, from economic management to border protection – the political gravity in Australia is well to the right of where many Labor partisans and small-l liberal intellectuals might think it is.

None of this is to suggest that the policy and character differences between the two candidates have not been sharp.

The Welsh-born Julia Gillard, 48, is an avowed republican and atheist, whose heroes include British Labour firebrand Aneurin Bevan. a former feminist and socialist activist, she lives childless in a de facto relationship.

The English-born Tony Abbott, 52, is an unapologetic monarchist and devoted Catholic, whose heroes include Winston Churchill. a former seminarian and journalist, he now has a wife of more than 20 years and three daughters.

On policy, perhaps the biggest difference between the two parties concerns the government’s proposed national broadband network. Labor wants the government to spend about $30-billion to deliver 100-odd megabits per second to every household in the next decade. the coalition’s proposal is more modest, relying more on encouraging private-sector involvement in the Internet revolution, and questioning whether government can deliver on time, on budget or at all.

Notwithstanding these differences, there is no question that just as the United States remains a centre-right nation in the Obama era, so too does Australia under Labor.

In fact, so conservative is Middle Australia that when Ms. Gillard overthrew first-term prime minister Kevin Rudd in a an internal party coup in June, many Australians were angry and upset that the natural order had been radically changed, literally overnight, without their consent, even though mr. Rudd’s approval ratings were declining. the Aussie penchant for a “fair go” runs deeps in the national psyche.

And so, just as some American liberal Democrats became neoconservatives in the 1970s, so, too, has the erstwhile socialist Ms. Gillard been mugged by reality. To paraphrase Richard Nixon, we are all conservatives down under.

Well, not quite. To be sure, Labor’s failure to prosecute the case for a price on carbon has alienated its political base, culminating in a rise of support for the far-left Greens. That party is expected to a score a record-high 12 to 14 per cent of the popular vote, giving it control of the balance of power in the Senate.

The climate, political speaking, has nevertheless changed so much so that cap-and-trade schemes or carbon taxes no longer resonate with Middle Australia. Al Gore’s moment down under has come and gone.

For years, Labor deemed it blasphemy to question its grand ambition for an emissions trading scheme. But when mr. Abbott opposed the government’s legislative centrepiece on the eve of the Copenhagen fiasco last December and highlighted the perils of what he called a “big new tax” that would amount to economic pain and no environmental gain, Labor panicked and dumped the policy.

During this campaign, Ms. Gillard has hardly even mentioned climate change – at least until the 11th hour when she desperately sought to be the second choice of Green voters in Australia’s preferential-voting system.

Nor is climate change the only issue where Australian conservatism reigns. take the economy. Ms. Gillard has ditched mr. Rudd’s proposed 40-per-cent mining super tax, which threatened the resource-rich states of Queensland and Western Australia, on whose back Australia’s prosperity has ridden in recent years.

She has also repudiated the big-spending fiscal policy of her predecessor and even praised the economic reform legacy of Labor’s bête noir, mr. Howard.

Like Canada, Australia weathered the global financial storm in 2008-09. Labor argues that its $42-billion “stimulus” policies saved Australia from recession, but the reason has more to do with the resources boom and the starting point. when Wall Street collapsed two years ago, Australia had record low 4-per-cent unemployment, no debt, a $20-billion budget surplus and a properly regulated banking sector.

The consensus is that Australia has not suffered an economic contraction since the early 1990s because its leaders – on both sides of the divide – have implemented a smart mix of free-market economic reforms and sound monetary policy.

Then there is immigration. Since becoming Prime Minister in June, Ms. Gillard has changed Labor’s tune on asylum seekers and backed refugee offshore processing.

When the Labor government substantially watered down mr. Howard’s tough border-protection policies two years ago, it led to a significant increase in unlawful arrivals and to a collapse in public support for an orderly humanitarian refugee program, as well as large-scale legal immigration levels. the Liberal-National coalition, on the other hand, pledges to adopt an ever harder line on illegal immigration, with front-benchers promising to turn back the boats as a way of deterring the indiscriminate people-smuggling racket in Southeast Asia.

In what are termed the culture wars, Ms. Gillard has thrown up the white flag, vacating the battlefield to mr. Abbott on gay marriage, the republic and the bill of rights. Add to this her opposition to gay marriage and teachers unions, and it is easy to recognize that conservatism is deeply bred into the Australian mainstream.

All the available public opinion evidence, moreover, indicates that the key voting groups that help decide federal elections are sections of the socially conservative working and lower-middle classes – otherwise known as “Howard battlers,” the equivalent of Reagan Democrats in the United States.

In stark contrast with the so-called left-wing elites from metropolitan Melbourne and Sydney who care passionately about refugees, multiculturalism and man-made global warming, the “battlers” are mortgaged to the hilt after participating in a property boom that rivalled Canada’s.

Located mainly in the outer suburbs of Sydney and Brisbane and especially the sun-belt seats of Queensland, they are also deeply concerned about population pressures and illegal immigrants. It was these people Ms. Gillard and mr. Abbott have been courting in recent weeks.

Then there is foreign policy, where Labor and the coalition have clashed bitterly in the past, most notably over Vietnam and more recently Iraq. the subject rarely came up during the election, largely because Ms. Gillard and mr. Abbott virtually agree with each other. both are strong supporters of the U.S. alliance that has been the centrepiece of Australian defence policy since the second World War. they are deeply committed to the war effort in Afghanistan, where Australia has about 1,500 troops. (Last week, Australia lost its 18th soldier.) both are committed to the decades-long engagement with East Asia.

It is hardly surprising that a broad cross-section of the Australian people strongly supports the U.S. alliance. For one thing, it serves real and substantial interests, such as intelligence and the all-important security guarantee.

For another thing, the need for a great and powerful friend for this country of 22 million is deeply embedded in the national psyche. from its birth as a state in 1901, Australia has always sought a close association with a great power with which it shares values and interests.

But the nature of the alliance will change. the spectacular rise of China means different things for the United States and Australia. For the former, its main significance is the emergence of a potent geopolitical rival; for the latter, it is the opportunity for a rewarding partnership, and that opportunity is being eagerly seized by Australia.

China is Australia’s largest trading partner. with exports to and imports from China growing at more than 20 per cent a year, and with the compatibility that exists between Australia’s vast mineral and energy resources and the needs of the Chinese economy, it does not seem improbable that China will become even more important to Australia’s national interest.

To their credit, both Ms. Gillard and mr. Abbott, as well as their parties, recognize this reality. But there are also risks and uncertainties involved. Canberra won’t face a hard, stark choice between Washington and Beijing. But as numerous security analysts argue, Australia will need to learn to play a more demanding diplomatic game than ever before, one that will on occasion involve the difficult feat of riding two horses simultaneously.

That’s the medium to long term down under. For the immediate future, however, Australians are increasingly focused on the local. and regardless of the winner of this weekend’s tight election contest, Australia will remain a pretty conservative place.

Sept. 2 (Bloomberg) — Petroleo Brasileiro SA, Latin America’s largest company by market value, climbed to a two-week high after an accord to pay the Brazilian government $42.5 billion in stock for the right to offshore oil reserves.

Petrobras, as the state-run company is known, rose 63 centavos to 27.66 reais in Sao Paulo trading at 3:20 p.m. new York time, the highest since Aug. 18. It rose as much as 4.1 percent earlier. The benchmark Bovespa index fell 0.5 percent.

The value set for the 5 billion barrels will determine how much new stock Petrobras must offer minority investors in a sale estimated by UBS AG at about $12 billion. The swap agreement means the offering, which was delayed in June as Petrobras and the government awaited assessments of the reserves, will likely meet a Sept. 30 deadline, Armada Capital SA’s Eric Conrads said.

“It removes an overhang from the market,” Conrads, a hedge fund manager at Armada in new York, said in a telephone interview. “The main thing is you won’t have any more delays.”

Petrobras said yesterday it will pay an average of $8.51 a barrel for the oil after almost two weeks of negotiations with the government. Terms of the sale to minority investors planned for the end of this month will be disclosed Sept. 3, it said.

‘Maintain Stakes’

The company plans to issue enough shares to allow the government and minority investors to maintain their stakes. Finance Minister Guido Mantega and Petrobras Chief Executive Officer Jose Sergio Gabrielli yesterday declined to comment on the total value of the offering.

The share sale will likely raise about $12 billion from minority investors, UBS AG analysts Lilyanna Yang and Luiz Pinho said in a note today to investors. The total sale, including the $42.5 billion in stock Petrobras will swap for the reserves, will reach about $55 billion, they said. Gabrielli said in March it may raise as much as $25 billion from minority investors.

“this is the biggest operation ever done of its kind,” Mantega said in Brasilia yesterday. President Luiz Inacio Lula da Silva is “happy” with the price of the barrels, Mantega said.

Before today, Petrobras plunged 26 percent in Sao Paulo this year on concern it would pay more for the oil than it’s worth, diluting earnings.

Billionaire George Soros’s Soros Fund Management LLC, which oversees $25 billion, sold its Petrobras stock in the second quarter, dumping its biggest company holding. BlackRock inc., the world’s biggest asset manager, and Banco BTG Pactual SA also sold Petrobras in the quarter, according to Bloomberg data.

The price for the barrels is more than the $7.50 per barrel previously estimated by UBS’s Yang and Ted Harper, who helps manage about $6.8 billion at Frost Investment Advisors in Houston. a price of $7.50 a barrel or higher would force Petrobras to sell more shares to the government than investors expect and dilute earnings, Yang said in an Aug. 11 report.

”The price is high, it doesn’t reflect the real risk of operating in these types of conditions,” said Christopher Palmer, who oversees about $5 billion at Gartmore Investment Management Ltd. in London, in a telephone interview today. “If fund managers feel they will be diluted, they may not participate in the way Petrobras’s advisers anticipated.”

Haroldo Lima, head of the Brazilian oil regulator known as the ANP, said in an Aug. 12 interview that $8 a barrel would be a “reasonable price” for the reserves.

about 3.1 billion barrels of the reserves will come from Franco, Petrobras said in yesterday’s statement, while the Iara and Florim fields will account for another 1.07 billion. Petrobras, based in Rio de Janeiro, will also receive the rights to oil at Tupi Northeast and Sul and Guara East fields.

Lula’s Regulations

The planned public share offering will help raise funds for a $224 billion plan to develop offshore fields and boost refinery capacity.

Partners in the pre-salt area include BG Group Plc, Galp Energia SGPS SA and Repsol YPF SA. BG shares climbed 1.4 percent at 11:42 a.m. in London, Galp slipped 0.9 percent in Lisbon and Repsol advanced 0.8 percent in Madrid.

The oil-for-stock swap is part of new regulations from Lula late last year to increase government control over reserves after Petrobras discovered the Tupi field, the largest oil find since Mexico’s Cantarell in 1976. Lula received two separate independent valuations on the crude reserves on Aug. 19 from Petrobras and the ANP. The ANP, government and company began negotiations on Aug. 20.

Petrobras said last month it was treating the price talks as a “commercial transaction” and that “it’s natural that both parties would seek to maximize their results.”

Petrobras in June named Banco Bradesco SA, Citigroup inc., Itau Unibanco Holding SA, Bank of America Corp., Morgan Stanley and Banco Santander SA to manage the share sale and that Banco do Brasil SA will manage the offering to minority investors in the domestic market.

Chief Financial Officer Almir Barbassa said Aug. 13 that the share sale is needed to replenish capital after debt rose to the upper limit of the company’s target. Debt as a percentage of equity rose to 34 percent in the second quarter, from 32 percent in the previous quarter and 28 percent in the year-earlier period, Petrobras said in its earnings report.

SAN MATEO, CA–(Marketwire – August 23, 2010) – As of this weekend, an additional set of new regulations from the Credit Card Accountability, Responsibility, and Disclosure (CARD) Act became law. Like previous changes, these new rules are designed to protect consumers by adding clarity and transparency to interactions between card issuers and holders.

However, as these new rules take away revenue opportunities for card companies, issuers are raising other fees or creating new ones to compensate. Money resource Bills.com cautions consumers to be aware of the new rules and also learn how to avoid new fees.

“Unfortunately, one of the unintended consequences of these new regulations is that consumers must be more vigilant than ever as we enter a period of uncertainty surrounding fees and services,” said Ethan Ewing, president of Bills.com. “These actions by most card issuers are perfectly legal, but they are certainly outside the spirit of the new law.”

The first rounds of changes brought on by the Credit CARD Act required issuers to provide more notice about interest rate increases to consumers, ended controversial practices such as inactivity fees, and required more transparent communication around payment windows and information.

Changes in the Law

The final set of changes that took effect on August 22nd, 2010 include:

  • Maximum limit on late fee penalties of $25 or no more than your minimum payment due. the one exception allows for high penalties if the cardholder has multiple late payments within the past six months.
  • Limiting penalties to one charge per issue. For example, the issuer cannot charge an additional penalty for each day a payment is late.
  • Any increase in interest rates must be accompanied by a clear explanation for the reason behind the increase.
  • Issuers must re-evaluate any interest rate increase six months after it is instituted to determine if there is cause to revoke the increase.
  • The official end to inactivity fees so that issuers can no longer charge for not using a credit card over a certain time period.

Consequences of Changes

As card issuers have realized diminished revenue from some of these changes they have begun to identify workarounds or even new fees to supplement their losses. the most straightforward example of these changes is a rise in annual fees by many card issuers. according to a report by Pew Charitable Trusts, the industry’s median annual fee on bank credit cards has jumped 18 percent between July 2009 and March 2010. Similarly, issuers have begun to raise balance transfer fees and foreign transaction fees, shorten billing cycles, and issue rebate cards that are exempt from the CARD Act to combat rate increases. Additionally, some issuers are skirting the ban on inactivity fees by raising annual fees but waiving or reducing them if cardholders meet an annual spending threshold. 

Solutions

In order to avoid these fees, personal money resource Bills.com shared six strategies consumers can employ to better avoid additional charges that have arisen because of changes outlined in the Credit CARD Act.

1. Monitor your communications from your credit card issuer. One of the best ways to stay abreast of changes specific to your cards or situation is to closely monitor information sent from your issuer. New regulations require much greater disclosure on all changes, so any update will be sent to your attention. be alert for all mailings and read them carefully before throwing away or destroying.

2. Maintain prompt payment status with your credit card company. Despite all these changes, the simplest way to avoid fees is to pay your credit card bills on time. By missing or being late on a payment you will incur fees, potentially increase your interest rate, and lower your overall credit score.

3. Pay down high balances to improve credit card utilization. this will show that you can responsibly manage your credit limit, minimizing the chance of higher tiers of interest rates or reductions in credit limit. Additionally, better credit utilization will help boost your credit score.

4. Maintain activity on your credit card accounts. By using the revolving credit lines that you need or want to keep and promptly paying on them, you can help avoid cancellation of those credit card accounts. this will also help avoid faux inactivity fees and help boost your credit score, while having a long existing credit line closed could lower your score.

5. Avoid over-limit fees through responsible spending habits. Credit card issuers have begun to charge fees for opt-in over-limit coverage. By remaining aware of credit limits and balances, consumers can avoid a need for this service and these fees altogether.

6. New regulations do not apply to corporate or small business cards. this means some small business owners might consider using personal cards for business expenses because of fee and rate limitations. However, these owners should remain cautious because their personal credit scores could suffer in the event of missed payments or defaults. Conversely, be aware of companies that are increasing solicitations for corporate card members to avoid new regulations.

LOS ANGELES, Aug. 24 /PRNewswire/ — a federal judicial panel ruled today that the question of whether a false and misleading ABC News report libeled prominent South Los Angeles pastor Dr. Frederick K.C. Price should be decided by a jury.

The three-judge panel of the U.S. 9th Circuit Court of Appeals handed a victory to the founder of the 22,000-member Crenshaw Christian Center by reversing a lower court’s ruling that ABC’s and correspondent John Stossel’s misrepresentation of Dr. Price’s own words were protected by the First Amendment.

The 9th Circuit panel ruled that ABC had materially changed the meaning of Dr. Price’s words in a clip it broadcast from one of the pastor’s televised sermons, because it told viewers Price was speaking of himself when in fact he was speaking of a hypothetical person in a parable about lack of faith.

“We therefore hold that the district court erred as a matter of law in dismissing Price’s express defamation claim,” the Court ruled in remanding the case back to the district court. “Under controlling Supreme Court precedent on when journalists’ misquotations of statements made by public figures are false for purposes of establishing actual malice, there is a substantial likelihood that Price can establish that the publication of the Clip was false. Hence, we reverse the district court’s dismissal under the anti-SLAPP statute.”

Dr. Price said the decision struck a blow for justice and the constitutional rights of everyone whose reputation has been damaged by a deliberately false and misleading news report.

“We have been in this battle for the past three years because we want to see justice done,” said Dr. Price. “We could not in good conscience allow this wrong to be done and just sweep it under the rug. it is a matter of principle.”

Dr. Price’s attorney, Anthony M. Glassman of Glassman, Browning, Saltsman & Jacobs, said the case turned on the key fact that the pastor’s words were used in the ABC report to convey a “self-condemnatory” meaning that in truth was not there.

“Nothing in the First Amendment protects unfair and deceptive hit pieces premised upon factual misrepresentation,” Mr. Glassman said. “The ABC report used Dr. Price’s own words out of context so it appeared to be a self-condemnatory quotation, when in context his words had a materially different meaning. The U.S. Supreme Court ruled in Masson (Masson, 501 U.S.) that the public is not served by extending the First Amendment to such practices.”

The ABC story, which aired March 23, 2007 on both ABC’s Good Morning America and 20/20 programs, was headlined “Enough!” and questioned whether several ministers who preach the Prosperity Gospel had deceived their congregations by diverting donations to support their own lavish lifestyles.

The story included a film clip of one of Dr. Price’s televised sermons in which he is seen telling his congregation, “I live in a 25 room mansion, I have my own $6 million yacht, I have my own private jet and I have my own helicopter and I have seven luxury automobiles.”

In fact, Dr. Price was not speaking of himself. he was preaching a sermon about a hypothetical person who had great wealth but lived a spiritually unfulfilled life.

“Well I was pointing out that there is such a thing as bad success,” Dr. Price told his congregation in the sermon that was first televised on The Lifetime Network in 1997. Then, speaking the words that ABC used in its report, he described this hypothetical person’s wealth. But in the next sentence, which ABC did not air, he added that the man’s wife was unfaithful, his children were on drugs and his friends only liked him for his money. “Friends, to me that’s bad success,” Dr. Price told the congregation.

Dr. Price, who does not own a helicopter, a jet, a $6 million yacht, a 25-room mansion or seven luxury cars, sued ABC and Mr. Stossel for defamation. ABC moved for dismissal under California’s anti-SLAPP statute protecting free speech.

ABC’s attorneys had argued that since Dr. Price is wealthy and owns a large house and a luxury car, the use of the quote, even through admittedly false on its face, was substantially true and should be protected speech.

Mr. Glassman argued that the report, taken as a whole, used the pastor’s own words to falsely imply that he is dishonest, corrupt and unethical. a key point, he argued, is that the ABC report said Dr. Price “boasts” about his wealth, when in fact his ministry is founded on the belief that living a humble, Godly life leads to material prosperity.

“Dr. Price preaches that prosperity flows from the beneficence of God to those who live a morally sound, God-centered life,” Mr. Glassman said. “Preaching prosperity from God and boasting are not the same. ABC used his own words to falsely portray him as haughty and immodest, when his words actually reflect humility and modesty.”

“Under Masson, the district court in this case should have compared the meaning conveyed by the Clip as broadcast with the meaning of Price’s own words in the context of the sermon he actually delivered,” the 9th Circuit ruled.
